Court Says No Sex During Pregnancy is Not Reason for Cruelty-based Divorce

I hate to be a culturally insensitive and judgmental Westerner.

However, I must say I am glad I do not live in a patriarchal society where a man can file a divorce from his wife because she refused to have sex with him while pregnant and dared asked him to serve her tea in bed.

Those were the reasons one Indian man gave in his divorce claim alleging that his wife was cruel to him, thus warranting the formal separation.

The Delhi High Court stated sex by a woman during her pregnancy is not cruelty towards her husband entitling him to get divorce on that ground.

“Carrying a foetus in the womb she would obviously be inconvenienced by sex and assuming she totally shunned sex with the petitioner (husband) as her pregnancy grew would not constitute cruelty,” a bench of justices Pradeep Nandrajog and Pratibha Rani said.

Oh yeah, he also said that his wife was cruel because she asked for tea to be served in bed when she woke up in the morning. But how about the court said the wife’s request constituted laziness but asserted that “laziness is not cruelty.”

The fact that a court of law would actually call a woman “lazy” because she asked for tea blows my mind. What in the world?

The Family Court was of the view that the allegations made by the man in his plea were “sans any particulars” and “vague” and upheld a lower court’s decision to throw out his claims.

I’m still not convinced who “wins” in this case because the wife still has to be married to this man who called her lazy for asking to be comforted while pregnant and tried to dump her for not giving in to his demands for sex.
