Judge: Sherri Shepherd cannot Remove Her Name from surrogate Child’s Birth Certificate

Monday, an appeal court upheld a lower court’s decision that previously decided that Sherri Shepherd cannot remove her name from 1-year old LJ’s birth certificate, PEOPLE reported.

LJ is a product of a surrogate pregnancy in 2013 that started before The View cohost and her now ex-husband Lamar Sally split.

Surrogate carrier Jessica Bartholomew was still pregnant at the time.

Since the baby’s birth Shepherd has been trying to fight being parentally responsible for the offspring.

The two entered a settlement regarding payment of child support which is ongoing. In April, a Pennsylvania judge ordered the support and ruled that Shepherd is legally the baby’s mom.

But Shepherd appealed a trial court ruling denying her from removing her name from his birth certificate.

Her name was originally not included because she was not present at the birth, and refused to acknowledge she was the mother, resulting in litigation, Melissa Brisman, owner of the New Jersey-based Reproductive Possibilities, previously told PEOPLE.

Shepherd told the magazine in August that the only reason she agreed to the surrogacy is because she feared Sally wild leave her if she didn’t.

Sherri Shepherd: She agreed to Surrogacy so Ex wouldn’t Leave her

The View alum Sherri Shepherd is opening up about her controversial surrogacy and divorce.

Four months ago, a judge ordered the comedic actress to pay child support for the surrogate child she and her ex husband Lamar Sally arranged to bring into this earth but was born after the couple split.

In a new interview with PEOPLE, Shepherd suggests she agreed to the surrogacy in the first place out of fear Sally might have left her if she didn’t.

“My situation was a sense of, I didn’t state what I needed and what I wanted and what I didn’t want for being scared of somebody leaving the relationship,” Sherri told the magazine at a recent charity event. “There are consequences to everything, but I was scared to say, ‘That’s not going to work for me. I don’t want that.’”

Sherri has plans to file an appeal to the Pennsylvania judge’s ruling.

“He’s happy,” adds Sherri. “There nothing I can do. It’s out of my hands. You move on and I have a son. I have to take care of him so everything is good.”

Sherri also has a son named Jeffrey from her marriage to ex-husband Jeff Tarpley.

Judge: Sherri Shepherd is surrogate mom to child planned with ex

Yesterday, we blogged about Sofia Vergara‘s ex fighting for parenthood despite no longer being romantically involved with her and now today, Sherri Shepherd was also dealt a blow by her ex over parenthood.

A judge ruled Tuesday that Shepherd is legally the mother of a now 8-month old baby boy, conceived via surrogate and born on July 28, 2014.  Shepherd and ex husband Lamar Sally arranged for the surrogacy while the two were still together, but split before the baby, Lamar Sally Jr, was born. Court papers show the couple separated April 16, 2014.

With the ruling, Shepherd’s name will be listed on the baby’s birth certificate as the mother. The judge found that Shepherd was one half of the two people who caused the baby to be brought into this world.

“The court upheld what we believe is and should be the law in Pennsylvania,” Sally’s attorney Tiffany Palmer told E!News.  “If you set out to conceive a child through assisted reproduction and enter into contracts to do so, you cannot just walk away from your legal parental responsibility because you changed your mind.”

So far no comment from Sherri but Sally’s attorneys said  video shown during the proceedings of Shepherd expressing excitement over the surrogacy helped sway the judge’s decision. Indeed, we too blogged in 2013 about the surrogacy and Shepherd’s glee over becoming a mother with Sally.

Shepherd has a 9-year old son, Jeffrey, with her ex husband comedian Jeff Tarpley.
